Terms of Service
Effective May 22, 2026
These Terms of Service ("Terms") govern your access to and use of the website, applications, and services (collectively, the "Service") offered by Foster Audio LLC ("Foster Audio," "we," "us," or "our"), a Texas limited liability company. By creating an account, submitting a project, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Foster Audio provides remote multitrack mixing services for worship teams and other clients. You upload audio stems through our client portal, and we deliver mixed, broadcast-ready audio files to you through the same portal.
2. Eligibility & Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us immediately at notandrewjones@gmail.com if you suspect unauthorized access.
3. Plans & Payment
We offer per-project pricing (Single Song, Full Service) and a recurring Monthly Plan. Pricing is displayed on our website and is presented again at checkout.
- One-time projects. Payment is charged at the time of submission via Stripe. Work begins after payment is confirmed.
- Monthly Plan. The Monthly Plan is a recurring subscription billed in advance every month at the rate displayed at checkout, until you cancel. Your card will be charged automatically on each renewal date. You may cancel at any time; cancellation takes effect at the end of the current billing period and no partial refunds are issued for unused time.
- Rush delivery. Rush delivery, if selected, is billed as an additional one-time charge at the time of project submission.
All amounts are stated in U.S. dollars and are exclusive of any taxes that may apply. Payment processing is handled by Stripe, Inc.; by paying, you also agree to Stripe's terms.
4. Refunds
Our refund policy is set out in full on the Refund Policy page and is incorporated by reference into these Terms.
5. Your Content
You retain all ownership, copyright, and other rights in the audio files, stems, notes, and other materials you upload ("Your Content"). You grant Foster Audio a limited, non-exclusive, worldwide license to receive, store, process, mix, and deliver Your Content solely for the purpose of providing the Service to you.
You represent and warrant that (a) you own or have all necessary rights and licenses to Your Content, (b) Your Content does not infringe any third party's rights, and (c) Your Content does not violate any applicable law.
6. Deliverables
On full payment, you receive the delivered mixes (WAV and MP3 files) for use in your ministry, business, or personal projects. You may use, distribute, broadcast, and archive the deliverables without further royalty to Foster Audio. Foster Audio retains the right to reference completed projects (e.g., client name or church name) in portfolio or marketing materials; if you prefer we not do so, email us and we will honor that request.
7. Revisions & Turnaround
Each plan includes the number of revision rounds described on the pricing page. Stated turnaround times (e.g., 48–72 hours) begin once your stems are fully uploaded and payment has cleared. Turnaround times are targets, not guarantees, and may be affected by file issues, holidays, or other circumstances; we will communicate any delays.
8. Acceptable Use
You agree not to use the Service to:
- Upload content you do not have the rights to use;
- Upload material that is unlawful, defamatory, or that infringes the rights of others;
- Distribute malware, attempt to gain unauthorized access to our systems, or interfere with the Service;
- Resell, sublicense, or otherwise commercialize access to the Service without our written consent.
We may suspend or terminate accounts that violate these Terms or that engage in chargebacks or fraudulent activity.
9. Intellectual Property
The Service, including the website, code, branding, and any proprietary processes, is owned by Foster Audio LLC and is protected by U.S. and international intellectual property laws. Nothing in these Terms transfers any rights to you except as expressly stated.
10. Termination
You may close your account at any time by contacting us. We may suspend or terminate your access to the Service at any time for any breach of these Terms. Outstanding deliverables for paid, in-progress projects will be completed in good faith unless the termination is due to a material breach by you.
11. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, Foster Audio disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any mix will meet every subjective expectation.
12. Limitation of Liability
To the maximum extent permitted by law, Foster Audio LLC and its owners shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to the Service. Our total aggregate liability for any claim arising out of these Terms or the Service shall not exceed the greater of (a) the amount you paid to Foster Audio in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).
13. Indemnification
You agree to indemnify and hold harmless Foster Audio LLC, its owners, and its contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from (a) Your Content, (b) your use of the Service, or (c) your breach of these Terms.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Angelina County, Texas, and you consent to the jurisdiction of those courts. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
15. Changes to These Terms
We may update these Terms from time to time. The effective date at the top of this page reflects the most recent revision. Material changes will be communicated by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
